FOCUS IMAGE TERMS AND CONDITIONS

RESERVATIONS
Reservations are accepted on a first-come, first served basis. You will be accepted upon receipt of the signed reservation form along with your 50% deposit/s. Space can only be reserved for the number of people for whom a deposit is received. All remaining unpaid balances are due in full no later than 30 days prior to your workshop date.

CANCELLATIONS AND REFUNDS
Any cancellations must be received in writing. Fifty percent of the deposit paid is non-refundable, and the total amount paid becomes non-refundable if cancellations are received during the 30-day period prior to your workshop date. There are no refunds for any unused portion of any workshop, should you need to leave.

DAILY ITINERARY CHANGES OR CANCELLATION OF WORKSHOPS
We reserve the right to alter any daily itinerary on any workshop for any prudent reason deemed necessary. We also reserve the right to cancel any workshop for any prudent reason deemed necessary. In such an event of cancellation, all payments received by Focus Image will be fully refunded. Focus Image will not be responsible for any expenses incurred by workshop members in preparing for a workshop that is cancelled.

MEDICAL
Participation in our workshops requires that you are generally in good health. It is essential that persons with any medical problems and related dietary restrictions make them known to us well before your arrival date.

LIMITATIONS OF LIABILITY
Focus Image, it¹s employees, assignees and co-operative agents, shall not be held responsible or liable for personal injury, death, delay, accident, sickness, loss or damage of personal property, natural disaster or loss of expenses occasioned by
any act or commission of any supplier providing services to any person.

COPYRIGHT
Focus Image is happy that members want to present their work outside the family circle and will help them to do so in accordance with the protection of the image as well as the intimacy and financial rights of models.

Focus Image also reserves the right to use photographs taken by Members while attending a workshop for promotion and marketing and for the portfolio of Models, Make-up/Hair artists and Stylists.

The MODEL RELEASE issued by Focus Image offers the following usage and restrictions:
1. Permission for Members to use photographs for portfolios or books
2. Permission for Members to use photographs on their Internet sites, as long as it is only for showing personal work and does not and will not include at any time, pornographic or erotic pictures or text. The site may not contain any banner advertising, publicity or sponsorships. No photographs can be presented in, or be in relation with, a site proposing some form of payment per click or for selling the images.
3. Exhibitions. The presentation in personal and collective exhibitions is authorised as long as the theme is of a Fine Art nature (not glamour or erotic). Members are allowed to sell their original prints if they so wish.
4. Publication in magazines for any editorials is strictly forbidden. The use of photographs for any publicity or media must first be discussed and terms agreed upon by Members, Focus Image and the Model Agency.
5. Publication of photographs in magazines or books regarding Fine Art or Photography Techniques is authorised as soon as written agreement has been issued by Focus Image for each photograph concerned.
6. Family name of models or name of Model Agencies may not be used without written authorisation from Focus Image.
7. Any another commercial or non-commercial use is forbidden. However some commercial and non-commercial use can be negotiated with the Model Agencies and Focus Image. All discussions are exclusively done through Focus Image who will act as an agent for the photographer.
8. Focus Image reserves the right to destroy the negatives or the files of any pictures taken by members that could in any way seem indecent or harmful to the career of the models.
9. You are kindly requested to give a copy of your everyday pictures to focusimage team, in order to make a selection of fashion pictures for the model agencies and to add on the focusimage website.

RULES OF PHOTOGRAPHY CONDUCT
As all our models are professionals, it is imperative for us to protect their interests and thereby ask members to respect the rules defined by Focus Image and the Model Agencies we work with:
* Members are instructed not to enter a studio or interfere with (even from afar), the individual shooting of another member.
* Shootings are exclusively done during the time given to each member and photographs are only to be taken when the model is purposefully posing in theses sessions.
* Fine Art photographs are to be of an artistic nature, not erotic or glamour.
* Photographs are not to be taken of the genital area and preferably not pubic hair, preferably in shadow and possibly not at all if requested by the model
* No requests for vulgar posing or attitude e.g. holding breasts, open-mouth, tongue visible etc.
* No physical contact may be made with the models to change their positioning. Members must communicate this through words, their own actions or an instructor.
* Backstage shooting in nude or half nude is strictly forbidden, as is nude shooting at any time when instructors are not aware of it.

MEMBER SUPPLIES
All members are responsible for travel costs and travel arrangements to the workshop locations. It is recommended that you do not confirm airline arrangements until 30 days before the workshop (Focus Image assumes no liability for reimbursement of airline tickets or other expenses due to the cancellation of a workshop). Members are also responsible for furnishing your own cameras, films, processing, batteries and accessories needed to participate in the workshops. You agree that you are responsible for any additional charges occurred by you that are not included in the workshop.

RÉSERVATIONS
Les réservations sont prises suivant l’ordre des dates où elles nous parviennent. Elles sont soumises à la signature de votre réservation, au paiement des arrhes et au nombre de places disponibles. Une somme de 50% du montant total du stage sera perçue à titre d’arrhes, au moment de l’inscription. A réception de votre réservation signée et des arrhes, vous recevrez un reçu confirmant votre participation au stage avec mention des dates, du coût total par personne, des arrhes reçues et du solde à régler au maximum 30 jours avant la date de votre arrivée au stage.

ANNULATION ET REMBOURSEMENT
Toute annulation se fait par écrit. Il ne sera opèré à aucun remboursement des arrhes si l’annulation se fait moins de trente jours avant le début du stage. Aucun remboursement ne sera effectué en cas de départ en cours de stage quelque soit la portion de stage non effectuée.

CHANGEMENT DE PROGRAMME ET ANNULATION DES STAGES
Nous nous réservons le droit de changer le programme des stages en cas de nécessité. Nous nous réservons le droit d’annuler tout stage en cas de nécessité. En cas d’annulation tous les paiements reçus seront intégralement remboursés. Focus Image n’est pas responsable des frais engagés pour le voyage (billet d’avion etc.) ou pour la préparation du stage annulé.

CONDITIONS PARTICULIÈRES
Santé: la participation à nos stages suppose une bonne condition physique générale. Les personnes suivant un traitement médical ou un régime alimentaire particulier sont priées de le signaler à l’inscription.

LIMITATION DE RESPONSABILITÉ, ASSURANCES
Focus Image, ses membres, employés et collaborateurs ne sont pas responsables des accidents, dommages ou préjudices survenus aux participants et aux accompagnateurs lors de leur séjour. Nous vous invitons à vous prémunir en souscrivant un contrat d’assurance adéquat.

DROITS DE REPRODUCTION
Focus Image est en relation avec des banques d’images et agira comme votre agent exclusif pour la promotion des photos prises pendant le stage. Un état des ventes vous sera fourni 2 fois l’an le cas échéant. Vous toucherez 50% moins les frais des montants reçus.
Les photos de mode prises par les participants aux stages sont réservées à leur usage personnel, dans le cercle de famille et à leurs portfolios personnels. L’utilisation des photos pour des expositions est soumise à l’autorisation écrite de Focus Image. L’utilisation dans les médias est interdite sans autorisation écrite de Focus Image.
Les photos de nus prises par les participants aux stages sont strictement réservées à l’usage personnel de participants, dans le cercle de famille et à leur portfolio personnel. L’usage dans les médias (magazines, publicité, internet etc.) est strictement interdite. L’usage pour des expositions est soumise à l’autorisation écrite de Focus Image.

TRANSPORT ET ÉQUIPEMENT
Les frais de transport (aller et retour) sur les lieux du stages sont à la charge des participants et des accompagnateurs. Nous vous conseillons de ne pas confirmer vos vols plus de trente jours avant le départ. Les participants se muniront de leur appareil photo, films, piles et accessoires pour les prises de vues.
Tous les frais non spécifiés dans le contrat sont à la charge des participants et des accompagnateurs.
